This reputation was solidified when the New York printmaker Currier and Ives published a lithograph depicting Meagher on horseback, leading his brigade in a bayonet charge. This experiment was unsuccessful, and thereafter Meagher would command only Irishmen. The Irish Brigade arrived in battle after a quick march through the Chickahominy River , as reinforcements for the weakening V Corps.

Later, this march and battle were considered by historians as the highlight of Meagher's military career. The Irish Brigade suffered huge losses at the Battle of Antietam that fall. Some reports said Meagher had been drunk,  but Maj. George B. McClellan 's official report noted that Meagher's horse had been shot. The Irish Brigade suffered its largest losses at the Battle of Fredericksburg. Meagher spent the next four months recovering from his injuries, and resumed his command three days prior to the Battle of Chancellorsville.
Meagher's fellow Irish leader, Col. Corcoran, had been exchanged and promoted Brigadier General, but he died in December So the Army rescinded Meagher's resignation on 23 December. Meagher briefly commanded a provisional division in the Army of the Ohio 9—25 February ; he resigned from the Army on May After the war, Meagher was appointed Secretary of the new Territory of Montana ; soon after arriving there, he was designated Acting Governor.
Meagher attempted to create a working relationship between the territory's Republican executive and judicial branches, and the Democratic legislative branch. He failed, making enemies in both camps. Further, he angered many when he pardoned a fellow Irishman who had been convicted of manslaughter. The Territory of Montana was created from the eastern portion of Idaho Territory as its population increased with an influx of settlers following the discovery of gold in When the Civil War ended, many more settlers entered the territory.
Searching for riches, they often disregarded U. In , Montana pioneer John Bozeman was allegedly killed by a band of Blackfeet , who attacked other settlers as well.

Meagher responded by organizing the Montana Territory Volunteer Militia to retaliate. He secured funding from the federal government to campaign against the Native Americans, but was unable to find the offenders, or retain the militia's cohesion. He was later criticized for his actions. Meagher called Montana's first constitutional convention to develop a constitution as a step toward statehood. Not enough residents voted for the constitution and statehood to qualify. In addition, copies of the constitution were lost on the way to a printer, and Congress never received copies for review.
Montana gained statehood in , more than 20 years after Meagher's death. When he reached Fort Benton, he was reportedly still ill. Sometime in the early evening of 1 July , Meagher fell overboard from the steamboat G.
Thompson , into the Missouri River. The pilot described the waters as " Some believed his death to be suspicious and many theories circulated about his death. On the frontier men were quick to kill rather than adjudicate. By the late 20th century, John T. Hubbell suggested that Meagher had been drinking, and fell overboard. He was also survived by his second son by his first wife, Catherine. Their first son died as an infant in Tasmania. Catherine gave birth to the second son, also named Thomas Francis Meagher, in Ireland after being with Meagher for a time in the United States.
She died soon after the birth, and their son grew up in Ireland reared by the family of his father, whom he would never meet.

The Irish Brigade commander was born in Waterford City, Ireland on August 23, ; a well educated orator, he joined the young Ireland movement to liberate his nation. He escaped to the United States in and became an American citizen. Subsequently Meagher raised the Irish Brigade and commanded it from February 3, to May 14, til later commanded a military district in Tennessee.

He was compared favorably with Wolfe Tone and Robert Emmet. In , Meagher made his first speech on a crowded political platform, in Conciliation Hall in Dublin. Instead, he delivered a speech that has never been surpassed for its brilliancy and lyrical grandeur. No, for at its blow a giant nation started from the waters of the Atlantic, and by its redeeming magic, and in the quivering of its crimsoned light, the crippled colony sprang into the attitude of a proud Republic.
In he made two anti-Union speeches that were transcribed by English agents. As a consequence he was arrested, charged with treason and sentenced to be hung, drawn and quartered. His body was to be disposed of as determined by the English queen. Meagher was admitted to the New York Bar in At the first battle of Bull Run he served as acting Major of the regiment and led his men in battle with characteristic gallantry.
He next organized the Irish Brigade, raising over 7, men. In November of he left New York for Washington with the first regiment of the Irish Brigade; other regiments followed in rapid succession. In , he was appointed Brigadier General. One observer described the Irish troops, with green flags flying made by Tiffany, using embroidered ancient Fenian and Gaelic mottoes, and even today on view at the Armory on Lexington Avenue in New York , comparing them as if a brigade on parade, with bayonets fixed, in serried ranks and closing in on the Confederates, their purpose to insert themselves between the men of the brilliant Stonewall Jackson and the gallant campaigners of General Longstreet.

Even under fire, the Irish were halted by General Meagher to allow a few solemn moments permitting their immortal Chaplain William Corby of Notre Dame to bless his men.
